The following FAQ would be useful:<\/p>\n<p><strong>1. Who benefits?<\/strong><\/p>\n<p style=\"text-align:justify;\">All print impaired persons be they totally blind, low\u00a0vision, learning disabled or orthopedically challenged in certain ways\u00a0are covered by this clause.<\/p>\n<p><strong>2. What can be done now that was not possible earlier?<\/strong><\/p>\n<p style=\"text-align:justify;\">Print impaired\u00a0individuals, or authorised service providers \/ organisations can\u00a0suitably modify a work under Copyright so as to make it accessible to\u00a0meet the specific needs of the print impaired person concerned. This\u00a0means that a standard printed book, for example may be converted to an\u00a0alternate format (not necessarily a special format) including Braille,\u00a0large font, text readable by screen reader, audio (be it synthetic\u00a0audio or human voice recording) without seeking the permission of the\u00a0rightsholder.<\/p>\n<p><strong>3. How is this different?<\/strong><\/p>\n<p style=\"text-align:justify;\">In the past, any alternate format creation\u00a0could have been defined as an infringement unless it was backed up by<br \/>\nprior written permission from the rightsholder. One had to seek the\u00a0permission if one had to be on the right side of the law. Now\u00a0thankfully we do not need permissions.<\/p>\n<p><strong>4. Are there any restrictions?<\/strong><\/p>\n<p style=\"text-align:justify;\">Yes, there are reasonable restrictions such as<\/p>\n<p style=\"text-align:justify;\">&#8211; conversion should be a not for profit activity. In case it is a for\u00a0profit activity, there is a separate clause under which a special\u00a0license can be obtained.<\/p>\n<p style=\"text-align:justify;\">&#8211; the beneficiaries has to be a bonafide print impaired person or\u00a0organisations that serve them.<\/p>\n<p style=\"text-align:justify;\">&#8211; reasonable precaution need to be taken by all that the accessible\u00a0copy is not misused commercially.<\/p>\n<p><strong>5. Does this mean that the publisher has to give soft copy? <\/strong><\/p>\n<p style=\"text-align:justify;\">No. The\u00a0copyright law does not cover the delivery of books which is the\u00a0perview of another department and another law. We are planning to take\u00a0it up as well. For the present, these exemptions allows an existing\u00a0work which is not accessible to be made accessible without permission.<\/p>\n<p><strong>6. Can accessible copy be shared?<\/strong><\/p>\n<p style=\"text-align:justify;\">Effectively yes, as long as it is\u00a0not misused for commercial purposes and is available to print impaired\u00a0persons only.<\/p>\n<p><strong>7. What is the wording of the clause?\u00a0<\/strong><\/p>\n<p style=\"text-align:justify;\">It runs as follows.<\/p>\n<p>Section 52 (1)The following act shall not be an infringement of\u00a0copyright, namely:\u00a0(zb) the adaptation, reproduction, issue of copies or communication to<br \/>\nthe public of any work in any accessible format, by \u2014<br \/>\n(i) any person to facilitate persons with disability to access to\u00a0works including sharing with any person with disability of such\u00a0accessible format for private or personal use, educational purpose or\u00a0research; or<br \/>\n(ii) any organisation working for the benefit of the persons with\u00a0disabilities in case the normal format prevents the enjoyment of such\u00a0works by such persons:<br \/>\nProvided that the copies of the works in such accessible format are\u00a0made available to the persons with disabilities on a nonprofit basis\u00a0but to recover only the cost of production: \u00a0Provided further that the organisation shall ensure that the copies of\u00a0works in such accessible format are used by persons with disabilities<br \/>\nand takes reasonable steps to prevent its entry into ordinary channels\u00a0of business.<br \/>\n<strong>Explanation.<\/strong> For the purposes of the sub-clause, \u201cany organisation\u201d\u00a0includes an organization registered under section 12A of the Income\u00a0Tax Act, 1961 and working for the benefit of persons with disability\u00a0or recognized under Chapter X of the Persons with Disabilities (Equal\u00a0Opportunities Protection of Rights and Full Participation) Act, 1995 \u00a0or receiving grants from the Government for facilitating access to\u00a0persons with disabilities or an educational institution or library or\u00a0archives recognized by the Government.<br \/>\nHope this clarifies many doubts.
